Using the service
You may browse the catalog and submit a clothing description, public HTTPS product link, garment photo, or stated fiber composition to receive results. You must use the service lawfully and only submit material you have a right to submit.
Acceptable use
Do not attempt to bypass request limits, probe private networks, interfere with the service, upload malware, submit a photo of another person without a lawful basis, scrape the site in a way that harms availability, or use results to mislead others. We may restrict access needed to protect the service.
Information, not medical advice
Material Evidence compares garment composition, disclosed finish claims, style attributes, and cited research about fiber classes and textile processing. It does not diagnose, prevent, treat, or assess a health condition, and it does not determine that a specific garment is safe, unsafe, toxic, or non-toxic. Consider professional medical advice for personal health questions.
Product information and external sites
Prices, availability, materials, and retailer statements can change. Vetted status reflects the evidence reviewed for a specific item at a point in time, not every product made by a brand. Live-found results are not vetted. Purchases occur on third-party retailer sites and are governed by the retailer's terms, privacy notice, shipping rules, and return policy. Material Evidence does not currently take payment or sell products.
Intellectual property
The Material Evidence name, original interface, editorial text, and original compilation are protected to the extent permitted by law. Brand and product names belong to their respective owners and are used to identify products and evidence. You may not imply that a brand endorses Material Evidence without permission.
No warranties
The service is provided on an “as is” and “as available” basis. To the extent permitted by law, Material Evidence disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy. Consumer rights that cannot legally be waived remain in effect.
Limitation of liability
To the extent permitted by law, Fareed Sayegh and Material Evidence will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, or losses caused by reliance on a retailer or product listing. [[NEEDS INPUT: proposed monetary liability cap and whether any applicable consumer-law carveouts should be stated]]. Some jurisdictions do not allow certain exclusions, so these limits apply only as far as the law permits.
Governing law and disputes
[[NEEDS INPUT: whether Nevada law should govern and whether state and federal courts in Clark County, Nevada should have exclusive jurisdiction]]. The tradeoff is that a home-state forum is simpler for the operator, while mandatory consumer protections and venue rights in a visitor's jurisdiction may still control.
Changes to these terms
We may update these terms as the service changes. The revised terms will show a new last-updated date. For a material change, we should provide prominent advance notice where reasonably possible. Continuing to use the service after the effective date means the revised terms apply, except where law requires a different form of consent.
